Webster: Can a State Prohibit the Public Funding of Abortion?

Justice Blackmun is best known as the author of Roe v. Wade, a distinction that will forever include him on the progressives' list of best Supreme Court Justices. Justice Rehnquist joined the dissent of Justice White in Roe. Later, after becoming Chief Justice, Rehnquist remained consistently pro-life throughout his career on the Court. With the plethora of books and articles analyzing Roe, this chapter looks at one of its successors - Webster v. Reproductive Health Services. Considered over 15 years after Roe, the Court in Webster reviewed a Missouri law that (1) prohibited public employees from providing or helping in abortions not necessary to save the life of the woman, (2) banned the use of public buildings for providing abortions, (3) required doctors to perform viability tests if the pregnancy was at least 20 weeks, and (4) declared in the law's preamble that "the life of each human being begins at conception." In an opinion written by Chief Justice Rehnquist, the Court upheld the Missouri law in spite of Roe. In dissent, Justice Blackmun castigated the Court's retreat from Roe. Both Justices again voted consistently with their worldview.
